Last year the Commission upheld a complaint that children at All Starswere being force-fed and given out-of-date food (News, 22 March2007).
Inspectors found persistent failures to meet the terms of improvementnotices served on the nursery and growing concerns over food hygienefailings, checks on staff, and suitable management and staffing.
Chris Stadames, the Care Commission's regional manager for the north ofScotland, said, 'We have worked closely with this nursery over aconsiderable period of time to make them fully aware of theirresponsibilities and to highlight where they need to make improvements.But they have consistently failed to make the improvementsrequired.'
Sheila Davies, who has been banned from working with children on thepremises, and her partner have now exercised their right to an appeal,which will be heard in the Sheriff Court. The nursery is to stay openuntil a verdict.
An improvement notice sent in June said, 'The lack of a qualified andexperienced manager is impacting negatively on the quality of children'scare and experiences.'
It added that enhanced disclosure checks had not been carried out onseveral members of staff.
In the latest improvement notice in July, the Care Commission proposedto cancel the registration of the nursery unless significantimprovements were made.
