A nursery owner accused of assaulting a two-year-old girl in her care is braced to receive a verdict from a magistrate's court this week. Olive Rack, owner of Tresco House Day Nursery in Kettering, is charged with common assault by Northamptonshire Police. In an incident last July, she allegedly used excessive force when reprimanding the child, who had hit a baby with a toy brick.

Most of the 1,100 providers initially judged inadequate by Ofsted under the new inspection framework have been found satisfactory on re-inspection. The Ofsted report Making a difference, published on Friday, said that around 3 per cent of childcare providers were found to be inadequate between April 2005 and June 2006.

I was interested to read the Policies and Procedures article (18 January) on dealing with illness, accidents and medicines within nurseries. However, I was concerned to note that in the section regarding accident policy and procedure there was no reference to the Health and Safety at Work Act 1974 or the Reporting of Injuries, Diseases and Dangerous Occurrences regulations 1995. A good policy will ensure there is a suitable system for recording all incidents and that the management review these on a regular basis. It is also important that serious accidents are investigated and lessons learned.
