i am currently working towards my nvq3. i have been at my nursery now over a year and a half. i started there as a student on nvq2 and when i finished level 2 they enployed me as casual staff on £5.35 an hour i have been a staff member now since feb 06. the owner has now said that they want me to work 30 hours unpaid as i am still traning and they want to keep costs down and they shouldnt have to pay for students. does anyone know if they can do this. i have a flat and bills to pay for and will have to leave nursery if they wont pay me. i love working there and really dont want to go.

well thats not fare so they want you to go from being a staff member back to a student. thats going to be difficult im not to sure about the legal stuff but surly they cant expect you to work 30 hours for nothing.you could try speaking to the owner to come to some kind of agreement. does anyone else know if this is aloud?

No one in their right minds can expect you to work for nothing, student or not. You have not said how old you are but there are minimum training wages, minimum wages for over 21's and so on. Go on to a web site for minimum wage or speak to acas. The long and short of it is DO NOT WORK FOR NOTHING.

i think you will find that she could be right. if you are training you do not have to be paid the min wage/
however! i think it is disgusting that they are expecting you do do someones job for nothing. try and get a placement elswhere as if they are cutting corners now, then what will they be like when you do "work" for them.

this is appalling and if they try to do this to you you should defo look for a new job.

our unqualified staff who are working towards their level 2 get paid minimum wage for their age,

if they are under 17 they get an apprenticeship wag.

our staff working towards a level 3 get paid a level two wage (which is slightly above min wage)which will then go up when they qualify level 3.

you already have a level two and have been classed as such for months, to put you back as an unpaid student is really taking the biscuit!!!!

If you have your NVQ 2, and have been working there for over a year, surely you have already been classed as a staff member and therefore should be paid, they are using you as 'free' staff to cover ratio's, DONT STAND FOR IT! Tell them you want paying or find another job, there will be plenty of settings that will take you with just a level 2! Let us know what heppens! x

Hi
You do have employment rights after a year, and if you have a contract of employment and your terms and conditions of employment check your hours and rate of pay
